Global health fund probe uncovers $20m in losses (AP)

GENEVA ? A global health fund investigating its own losses in grant money said Tuesday that 12 more probes had turned up an additional $20 million of mismanagement, alleged fraud and misspending.

The Global Fund to Fight AIDS, Tuberculosis and Malaria posted the results ? contained in three fraud probes, eight audits and an internal review of travel involving about $1 billion in grant money ? on its website.

Earlier probes by the fund's internal watchdog, the inspector general's office, had detected about $53 million in losses, according to fund documents, some unpublished, provided by senior officials.

The fund's board chairman Simon Bland told The Associated Press it has now reviewed about one-seventh of $14 billion in grants disbursed but it would be misleading to extrapolate the percentage of corruption turning up in fund programs.

He said the fund, which has approved more than $22 billion in grants since its creation in 2002 as a major financing tool, is demanding repayment of the money ? and two new cases in Nigeria and India could lead to criminal charges. The fund says it has recovered $19 million in misspent or undocumented money so far.

"We think the Global Fund standards of accounting are really high," Bland said. "We will not tolerate misuse of our resources."

In Nigeria, the probe found $22 million in unauthorized foreign currency exchanges by a not-for-profit center in Abuja, that diverted hundreds of thousands of dollars to non-fund accounts. In India, at least $872,000 had been misappropriated, some transferred to a shell corporation and used to rent and renovate an official's home.

A third probe was in Mauritania, where $6.73 million in potential fraud and other losses were found but the country has already paid back $4.2 million.

Auditors also looked at grants in Dominican Republic, Madagascar, Sri Lanka, South Sudan, Swaziland and Togo, and examined almost a half-billion dollars in fund programs run by Washington, D.C.-based Population Services International.

Completion of the latest investigations and audits was delayed until after the end of a six-month review of the fund's financial controls by an outside panel created in the wake of Associated Press reports on the losses that prompted intense scrutiny from donors over the misuse of some grant money.

The Global Fund suspended grants ? or put in place new safeguards ? in Djibouti, Mali, Mauritania and Zambia. The European Commission and some nations had decided to withhold hundreds of millions of euros from the fund until they could be reassured.

In January, the AP reported that the fund was bleeding tens of millions of dollars to mismanagement and corruption, prompting Germany, the European Commission and Denmark to withhold a collective $457 million (euro315 million) in funding. Spain, Italy, Japan and Ireland also delayed committing to 2011 pledges.

Sweden had previously withheld a pledge based on the inspector general's findings.

The fund warned Germany that its withheld dollars would lead to the deaths of 43,000 people but Germany called that "extremely questionable" and said it's corruption that kills.

The fund then created an outside panel headed by former U.S. Health and Human Services Secretary Michael Leavitt and former Botswana President Festus Mogae. In September it recommended a major overhaul in the fund's financial practices.

Since the panel's report, Germany released half of its $285.7 million pledge.

It also said the unhealthy tensions must end between the fund's executive director, Dr. Michel Kazatchkine, who has sought to minimize the scale of misspent money, and the fund's inspector general, John Parsons, whose job is to probe for losses.

"If it's seen as a war, we have to stop that," Bland said.

Japan paid the Global Fund $114 million Monday toward its 2011 contribution but is keeping frozen a second amount ? some $178 million ? that it might release in December, fund spokesman Andrew Hurst said.

He said the European Commission is still awaiting the outcome of a board meeting later this month in Ghana before deciding whether to unfreeze its 2011 pledge of $185.7 million (130 million euros).

Hurst said Denmark's decision whether it might release its $33.5 million pledge for 2011 also might come next month.

McCourt, MLB agree to process to sell Dodgers (AP)

LOS ANGELES ? Embattled Los Angeles Dodgers owner Frank McCourt and Major League Baseball reached an agreement late Tuesday to sell one of the sport's most storied franchises, ending a seven-year tenure that saw the team return to the playoffs regularly but was recently mired in legal troubles capped by its filing for bankruptcy protection.

A joint statement said there will be a "court-supervised process" to sell the team and its media rights to maximize value for the Dodgers and McCourt. The Blackstone Group LP will manage the sale, which could include Dodger Stadium and the surrounding parking lots.

The announcement came as the Dodgers and MLB were headed toward a showdown in U.S. Bankruptcy Court in Delaware at the end of the month as mediation between both sides was ongoing.

McCourt and baseball Commissioner Bud Selig have traded barbs since MLB took control of day-to-day operation of the team in April over concerns about the team's finances and the way it was being run. McCourt apparently realized a sale of the team he vowed never to give up was in his best interest and that of the fans.

"There comes a point in time when you say, `It's time,'" said a person familiar with the situation who requested anonymity because details of the negotiations had not been made public. "He came to that realization at the end of today."

McCourt filed for bankruptcy protection in June after the league rejected a 17-year TV contract with Fox, reported to be worth up to $3 billion, that he needed to keep the team afloat. Selig noted that almost half of an immediate $385 million payment would have been diverted from the Dodgers to McCourt.

The franchise's demise grew out of Frank McCourt's protracted divorce with Jamie McCourt and the couple's dispute over the ownership of the team. The divorce, which played out in public in court, highlighted decadent spending on mansions and beach homes and using the team as if it were their personal credit card. They took out more than $100 million in loans from Dodgers-related businesses for their own use, according to divorce documents.

In bankruptcy filings, attorneys for MLB said McCourt "looted" more than $180 million in revenues from the club for personal use and other business unrelated to the team.

"The Dodgers are in bankruptcy because Mr. McCourt has taken almost $190 million out of the club and has completely alienated the Dodgers' fan base," the baseball attorneys wrote.

As the former couple continued to fight over ownership of the team, the Dodgers' home opener against the rival San Francisco Giants kicked off a year of even worse publicity. A Giants fan, Bryan Stow, was nearly beaten to death in the parking lot. Stow's family has sued the Dodgers, and his attorney said medical bills could reach $50 million.

In the outpouring of public sympathy, attention focused on cutbacks in security at Dodger stadium and fans turned their animosity toward Frank McCourt. Scores of police were dispatched to patrol the stadium after the attack.

Dodgers attorneys claimed Selig deliberately starved the club of cash and destroyed its reputation in a bid to seize control of the team and force its sale.

"As the commissioner knows and as our legal documents have clearly shown, he approved and praised the structure of the team about which he belatedly complains," the team said in a statement.

The team was asking Judge Kevin Gross in Delaware to approve an auction of the team's television rights as the best path to exit bankruptcy. But the league wanted to file a reorganization that called for the team to be sold.

Last month, Jamie McCourt cut a deal with her ex-husband to settle their dispute over ownership of the team they bought in 2004 for about $430 million.

The terms of the settlement between the McCourts weren't disclosed publicly, but a person familiar with it who requested anonymity because it's not meant to be public told The Associated Press that Jamie McCourt would receive about $130 million. She also would support the media rights deal worth up to $3 billion.

That removed her from the number of opponents Frank McCourt was facing in bankruptcy court because Jamie McCourt had initially lined up behind MLB and Fox in asking the bankruptcy court to reject his bid to auction Dodgers television rights.

All the bad publicity appeared to drive fans away. There was a 21 percent drop in home attendance from last season and it was the first time in a non-strike year since 1992 that the Dodgers drew fewer than 3 million people.

A new owner would be the third since Peter O'Malley sold the team to News Corp. in 1998. The Dodgers had remained in the O'Malley family since Walter O'Malley moved the team from Brooklyn to Los Angeles in 1958.

The Dodgers finished this season with an 82-79 record.

Plane passenger: 'We owe everything to the pilot'

A Boeing airliner carrying 231 people from the U.S. landed on its belly Tuesday in Warsaw after its landing gear failed to open, triggering sparks and small fires. No one was hurt, but some passengers sobbed as they prayed for a safe landing.

Capt. Tadeusz Wrona, who handled the descent so smoothly that many on board thought the plane landed on its wheels, was instantly hailed a hero in Poland and online, where within hours he was the focus of several Facebook fanpages.

The successful landing of the Polish LOT airlines flight, which came from Newark, New Jersey, also was a huge relief for a country that has suffered multiple aviation disasters in recent years, including the April 2010 crash that killed President Lech Kaczynski and 95 others.

"I was praying for the pilot not to lose control because we started to make circles over the airport. It was terrible," passenger Teresa Kowalik told reporters at the airport. "We owe everything to the pilot. He really did a great job."

LOT said the plane suffered "a central hydraulic system failure," indicating that the hydraulics used to extend the landing gear failed.

Flame retardant foam
The pilots discovered there was a problem before touching ground. They circled the 767 above the airport for about one hour before descending without lowering the wheels, said Przemyslaw Przybylski, a spokesman for the Warsaw airport.

The plane, escorted by two F-16 fighter jets, landed with nearly empty fuel tanks after dumping fuel in preparation for the emergency landing, LOT spokesman Leszek Chorzewski said.

A fire brigade laid out special flame retardant foam for the plane to land on. On landing, sparks flew from the engine and small fires erupted under the plane but were immediately put out by firefighters. The passengers evacuated the plane using an emergency slide.

The pilot told passengers four hours into the flight that the plane faced technical problems, said a passenger who would only give her first name, Malgorzata.

"The pilot addressed us a number of times and said we should follow instructions. Later, a flight attendant said there might be a fire, and at that point people began to get nervous and uncertain," she said.

"I started to cry, and the men around me were also crying," said another passenger, Krystyna Dabrowska, 62. "I thought that was the end of me."

By the time the plane landed, escorted by two F-16 fighter jets, its fuel tanks were nearly empty, LOT spokesman Leszek Chorzewski said.

The landing itself was so smooth that "we all thought we had landed on wheels," said Andrzej Pinno, a 68-year-old passenger.

Passengers even applauded, but then grew alarmed when sparks and black smoke rose from the plane. "This is the moment where we realized this was not a normal landing," added Pinno.

Passengers were then evacuated using emergency slides. They were taken to a medical center where they were kept several hours before being released to anxious relatives gathered at the airport.

"We were waiting for a crash, and we waited and waited and waited ? and thank God it never happened," said Greg Cohen, a passenger from Livingston, New Jersey. "It was a very lucky flight, a very, very great pilot. We are very fortunate."

Echoing the passengers, Polish officials and national media declared the pilots and rest of the crew heroes. LOT said there were 11 crew and 220 passengers on the LO 016 flight.

LOT airlines president, Pirog, told reporters that Wrona and co-pilot Jerzy Szwartz carried out a "perfect emergency landing," which prevented anyone from being injured. "Unfortunately it rarely ends this way," Pirog said.

Poland's President Bronislaw Komorowski congratulated and thanked the crew and emergency workers for ensuring no one was hurt.

"I thank everyone with my whole heart in the name of Poland," Komorowski said.

Within hours, at least six Facebook fan pages devoted to Capt. Wrona had appeared. On Twitter, admiration was profuse. One Tweeter insisted, "Give that pilot a medal!" Others drew comparisons to Capt. Chesley "Sully" Sullenberger, who became a national hero in the U.S. when he landed a crippled US Airways jet in the Hudson River and saved 155 lives.

Warsaw's Frederic Chopin International airport has been closed until 8 a.m. on Wednesday. Flights which had been scheduled to land in Warsaw have been diverted to Lodz, Gdansk and Krakow. The airport has two intersecting runways. The plane landed at the intersection, leaving both unusable temporarily.

The undercarriage of the Boeing 767 is made up of three parts, one under the nose and one below each of two wings. According to data from the Aviation Safety Network, there has never been such an incident involving the failure of the entire undercarriage on a Boeing 767.

Patrick Smith, a Boston-based pilot who flies the Boeing 767 for a major U.S. airline, said something "very mysterious" must have occurred.

"Something pretty high up in the architecture of the landing system must have happened for all three gears not to come down," Smith said. "Something that was obviously common to all three gears."

He said, however, that he did not expect the incident to have any lasting impact on Boeing, or on LOT.

"It's a plane with a long, proven track record and an excellent safety record. And the same applies to LOT."

WASHINGTON ? President Barack Obama will meet with former British Prime Minister Tony Blair in a private session Monday morning.

In the afternoon, Obama will sign an executive order the White House describes as part of his "We Can't Wait" campaign to help the economy. Saying the country can't wait for Congress, Obama has begun taking unilateral steps that he says will encourage economic growth. The actions do not require congressional approval.

The stalled Middle East peace process is a likely topic for discussion between Blair and Obama. Blair is the Mideast envoy for international mediators who last week failed in their latest attempt to bring Israeli and Palestinian officials back to the bargaining table.

(AP) ? Michael Vick tossed a 12-yard touchdown pass to Jeremy Maclin, LeSean McCoy scored on a 2-yard run and the Philadelphia Eagles took a 14-0 lead over the Dallas Cowboys after the first quarter of Sunday night's game.

Tony Romo was sacked twice and threw an interception to Nnamdi Asomugha on Dallas' first two possessions, and the Eagles dominated the first 15 minutes against their NFC East rival.

Vick had 67 yards passing and 35 rushing, and McCoy had 80 yards on the ground. The 115 yards rushing by Philadelphia already were more than Dallas had allowed in any game this season. The Eagles entered with the No. 1-ranked rushing offense and the Cowboys had the top-ranked run defense.

The Eagles took the kickoff and drove 79 yards for their first opening-drive TD this season. Vick was sacked by DeMarcus Ware on the first play, but he connected with Maclin for 24 yards on the next one. McCoy had a 21-yard run and Vick scrambled 15 yards to the Cowboys 13.

On third-and-9 from the 12, Vick tossed a screen pass to Maclin, who followed a lead block by Jason Peters into the end zone.

The Cowboys had excellent field position at their 45 to start after a penalty and an out-of-bounds kickoff. But a holding call and sacks by Jason Babin and Trevor Laws pushed Dallas back and Mat McBriar pinned Philadelphia at its 10 with a 38-yard punt.

Vick led the Eagles 90 yards with McCoy running in from the 2 for a 14-0 lead. McCoy had runs of 11 and 34 yards before scoring for the seventh straight game. He's one short of Steve Van Buren's team record set in 1947.

Coming off a 253-yard rushing performance in a win over St. Louis, Cowboys rookie DeMarco Murray got 4 yards the first time he touched the ball against Philadelphia.

The Eagles are looking to improve to 13-0 after a bye under coach Andy Reid. Teams were 3-9 after their byes coming into the weekend, but were 4-1 Sunday. After an awful 1-4 start, the Eagles can move into a three-way tie with Dallas and Washington for second place in the NFC East with their second straight win.

The Cowboys have won four of the past five meetings, including a playoff win in January 2010.

WASHINGTON ? Two former executives of State Street Bank & Trust Co. have been cleared of federal civil fraud charges of misleading investors about their potential risk from subprime mortgage investments in 2007.

The chief administrative law judge at the Securities and Exchange Commission issued an order Friday dismissing the charges filed last year against John Flannery and James Hopkins.

Judge Brenda Murray said neither Flannery nor Hopkins was responsible for the misleading documents alleged to have been provided to investors in the bond fund marketed by State Street Global Advisors.

Flannery was the chief investment officer of State Street Global Advisers; Hopkins was the head of product engineering.

Boston-based State Street agreed to repay investors about $300 million in February 2010 to settle charges by the SEC and Massachusetts regulators related to the bond fund. State Street also has paid around $340 million to investors to settle private lawsuits.

The SEC said the fund was marketed as an alternative to a money market fund. But it was almost entirely invested in securities tied to risky subprime mortgages, the agency said. The value of those securities plunged when the housing bubble burst in mid-2007.

Attorneys for Flannery and Hopkins issued statements Monday saying they were pleased with the judge's decision in a case they asserted should never have been brought.

NEW YORK (AP) ? Hugh Jackman is doing what he does best ? selling tickets.

The Broadway League says the Tony Award-winning performer's one-man show pulled in more than $1.2 million at the box office during eight preview performances last week.

"Hugh Jackman, Back on Broadway" beat out Daniel Radcliffe's "How to Succeed in Business" and the all-star cast of Stephen Sondheim's "Follies" the week ending Sunday.

In Jackman's show, he and an 18-piece orchestra perform songs from his stage and film career, including his star turn in "The Boy from Oz." The show opens Nov. 10.

Jackman's pull broke The Broadhurst Theatre's box office record, beating "700 Sundays" starring Billy Crystal, "Hamlet" with Jude Law and "The Merchant of Venice" starring Al Pacino.

(AP) ? Rights activists have criticized a Hollywood studio for filming a buddy comedy in an eastern Chinese city where a blind, self-taught activist lawyer is being held under house arrest and reportedly beaten.

Relativity Media is shooting part of the comedy "21 and Over" in Linyi, a city in Shandong province where the activist Chen Guangcheng's village is located. Authorities have turned Chen's village of Dongshigu into a hostile, no-go zone and activists, foreign diplomats and reporters have been turned back, threatened and had stones thrown at them by men patrolling the village.

The news that Relativity Media had chosen Linyi, a city of 10 million, as a location for its film and was touting its close government connections comes at a time when activists have renewed their attention on Chen. A campaign to visit the lawyer to draw attention to his plight has caught on and intensified over recent weeks, though none have succeeded and many visitors have been met with violence.

On China's popular Twitter-like microblog, Sina Weibo, some bloggers circulated email addresses for Relativity staff, urging users to write to the company in protest. A few called for a boycott of the film.

Relativity declined comment but said in a press release that filming in Linyi began last Wednesday. In the release, Linyi's top Communist Party official Zhang Shajun is quoted as calling Relativity's chief executive Ryan Kavanaugh a "good friend" while Relativity's Co-President Tucker Tooley describes Linyi as an "amazing" place.

"I hope Relativity Media will learn more about the real Linyi, about Chen Guangcheng, and see that what is currently happening in Dongshigu village is what is really 'amazing'," said Nanjing-based activist He Peirong in an interview.

"Especially at this time, when every day there are people trying to visit Chen Guangcheng, people who have been robbed and beaten, I express deep regret to see such remarks whitewashing the city of Linyi," she said.

In the past several weeks, dozens of activists and Chen's supporters have risked being violently assaulted to attempt visits to his home in a bid to draw attention to his plight. The latest group was made up of 37 petitioners who traveled there by bus from Beijing on Sunday and fled after being attacked by about 50 unidentified thugs as they approached Chen's village, said one petitioner, Peng Zhonglin, from Jiangxi province. Linyi police refused to comment when reached by phone.

Human Rights Watch senior Asia researcher Nicholas Bequelin said it was puzzling that Relativity appeared comfortable cozying up with the city's political leadership.

"They seem to be eager to assume this role of being a prop in Linyi's propaganda campaign to cast itself as a civilized municipality that promotes culture when the reality is that it is not only holding one of China's most prominent human rights defenders, but going to extraordinary lengths to persecute him," Bequelin said.

Relativity describes "21 and Over" as a comedy about two childhood friends who drag their friend out to celebrate his 21st birthday the night before a medical school interview in an evening that turns into "a wild epic misadventure of debauchery and mayhem." It stars "Footloose" star Miles Teller and Justin Chon who was in "The Twilight Saga."

Shooting in Linyi began on Wednesday and it was unclear how long they were scheduled to film there. Previous footage had been shot in Seattle, the company said. Relativity has produced or co-financed more than 200 movies including "Cowboys & Aliens," ''Bridesmaids," and "Limitless."

Blinded by a fever in infancy and self-taught as a lawyer, Chen became an inspiring figure among rights activists for his dogged pursuit of justice. We are currently expanding our Engagement Group?and seeking a highly motivated?Close ? Protection Specialist?to help support our efforts in the Global War on Terrorism in Afghanistan. The incumbent for this position will provide essential driving and protection of personnel and assets in support operational and administrative activities of the program within the Afghanistan Theater of Operations.

Specific Duties:
Responsible for providing driving support to contractor personnel in high-risk areas
Responsible for planning, coordinating, and executing motor vehicle convoy operations in urban and rural environments IAW NATO and Combined Security Transition Command ? Afghanistan movement control policy including but not limited to:
Route planning and analysis
Arrival and Departure procedures
IED Avoidance
Vehicle recover and self-recovery situations
Responsible for the force protection of embedded team members executing mentorship activities to Afghan National Army and Afghan National Police
Responsible for conducting weapons training, immediate action drills, and other security related activities required to accomplish operational requirements
Responsible for assisting research, analysis and written assessments on the purchase and implementation of new and current security equipment, vehicle and weapon employment in regards to protect program personnel
Carries and operates weapons as specified to accomplish daily operational requirements.


Requirements
Education:
Bachelor?s Degree highly desired
Experience:

A minimum of 10 years of relevant military, law enforcement, or protective security from the private sector
Operational experience with U.S. Army Special Forces Command (USASFC), United States Marine Corps Special Operations Command (MARSOC), 75th Ranger Regiment, and selected U.S. Armed Forces law enforcement organizations highly desired
Graduate of the U.S. Army SFARTAETC or service equivalent, SFAUC, Special Operations Training Group (SOTG), Special Mission Unit, Department of State Protective Services, or Federal Law Enforcement equivalent operators course desired
Exceptional weapons handling skills (MK 18, M9 or Glock 17, MP5, and AK-47)
Superior mounted and dismounted orienteering skills using maps and electronic navigational equipment
Must have recent deployment and operational experience in Afghanistan
Ability live and operate in an austere and hazardous environment
Active TOP SECRET Security Clearance preferred
Must have a Valid US Passport
Ability to work within multi-disciplinary teams
Strong organizational skills, and demonstrated ability to operate in independent and collaborative work environments
