A man who stepped in the middle of a scrap involving his stepdaughter and another girl at Sojourner Truth Academy in Uptown -- then stepped on the gas and smacked into a girl on Napoleon Avenue -- was sentenced Tuesday to 18 months in jail. Paul Amar, 43, surrendered to sheriff's deputies after Criminal District Judge Keva Landrum-Johnson handed down the sentence.

Amar pleaded guilty to aggravated battery and simple battery from what turned into a May 15 melee between families of the two high school girls, who had gotten into a spat over a posting on the mobile photo-sharing program Instagram.

The noontime brawl spilled from the parking lot of the nearby Freret Market into the middle of Napoleon Avenue.

A witness said Amar and the girl's mother arrived and quickly got into it with the mother and older brother of the?girl she'd been fighting.

The brother also was a student at Sojourner, and both girls ended up joining the skirmish. The Recovery School District charter school,?at Jena and Freret streets, was shuttered this year.

Hair was pulled, bricks were thrown, and fists. Then, Amar jumped in his truck with a small child inside and began heading the wrong way down Napoleon Avenue.

Police said Amar had argued with the 18-year-old male student because he suspected him of dating his daughter. He threatened the boy, then tried to run him over with his truck, but missed and hit his sister, police said.

She was taken to the hospital with apparently minor injuries.

The simple battery charge stemmed from fisticuffs?between Amar and the male student, said Amar's attorney, Michael Kennedy. Only Amar was arrested, Kennedy said.

"We are very pleased with the sentence that Mr. Amar received. At the heart of the matter, as shocking as the crime may have been to the general public, it does truly seem to have grown out of honest care and concern for his family," Kennedy said.

"And while Mr. Amar took that a couple of steps too far ... It was not the way to express it, but at least he cared."

Aggravated battery carries a maximum 10-year prison sentence.

Amar was still being booked late Tuesday.

A new ?extended look? at Hooper?s Les Miz highlights that aspect of the production via interviews with central cast members ? Hathaway, Hugh Jackman, Russell Crowe ? as well as supporting players such as Amanda Seyfried, Eddie Redmayne, and Samantha Barks.

Hooper?s approach with Les Mis?rables may prove somewhat divisive for musical theater lovers. On the one hand, as Jackman illustrates in the featurette, singing live does allow for more spontaneity in terms of performance; thus, the characters can behave in a more instinctive manner than they would striving to match pre-recorded vocals.

On the other hand, some hardcore Broadway fans prefer stage musicals that feature the talents of dedicated singers, rather than performers who are actors first and singers second. It?s for that reason that some music specialists take issue with films like Sweeney Todd and Mamma Mia!, where celebrities and acclaimed stars were cast over people with proven professional musician chops.

Les Mis?rables, however, has the advantage of a cast that includes a Tony-winner (Jackman) and a part-time professional musician with nearly three decades of experience (Crowe), as well someone who actually appeared in the original stage show (Barks). The majority of the rest of the cast has already demonstrated some musical prowess either onstage or onscreen, so they too seem worthy to tackle the challenge Hooper has set before them.

EU data chiefs ask Google to change privacy policy

BRUSSELS/PARIS (Reuters) - European Union regulators want Google to make changes to its new privacy policy to protect the rights of its users, the EU's national data protection regulators said in a letter to the U.S. internet company, which was seen by Reuters.

The letter, which stopped short of declaring Google's approach to collecting user data illegal, follows an investigation led by France's Commission Nationale de l'Informatique (CNIL) that began in February.

Leading the inquiry on behalf of Europe, France's data protection watchdog had already questioned the legality and fairness of Google's new privacy policy, introduced in March. This consolidated 60 privacy policies into one and pooled data collected on individual users across its services, including YouTube, Gmail and its social network Google+. Users cannot opt out.

The regulators' letter said: "Combining personal data on such a large scale creates high risks to the privacy of users."

"Therefore, Google should modify its practices when combining data across services for these purposes," the letter said. It was signed by 24 of EU's 27 data regulators plus those of Croatia and Liechtenstein.

Google declined to comment.

In the past, the company has said the changes would allow it to tailor search results more accurately and improve services for consumers. Google has also said previously it is confident that its privacy policy does not run foul of European law.

In the letter, the regulators listed 12 "practical recommendations" for Google to bring its privacy policy into line. The first five cover how Google tells people about how their personal information and browsing records will be used, highlighting location data and credit card data in particular.

The regulators also want Google to spell out its intentions and methods for combining data collected from its various services. They want the web search giant to ask users for explicit consent when bundling data together, the letter said.

ONLINE ADS

The pooling of anonymous user data across Google services, is a big advantage when selling online ads.

Google and other large internet groups like Facebook provide free services to consumers and earn money from selling ads that they say are more closely targeted than traditional TV or radio campaigns.

Chris Watson, a lawyer at CMS Cameron McKenna LLP, said: "Google is being very aggressive and are playing for high stakes because these (privacy policy) changes are very valuable to their advertising business."

"They may be prepared to test the legal position in Europe to see what they can get away with."

The tussle with the EU over data privacy comes at a delicate time for Google.

Europe's antitrust authorities are also examining the company's business model to see if it uses its clout in search advertising to favor its own services over competitors' offerings. Google is in talks with EU regulators on the case, and could offer concessions.

U.S. banks push back as financial-crisis lawsuits pile up

(Reuters) - As U.S. authorities seek to make Wall Street pay for its role in triggering the financial crisis more than four years ago, banks are starting to fight back, frustrated that they are being asked to pay more than once for the same conduct.

The result may be that federal and state authorities trying to extract penalties from the banks are forced to go through lengthy courtroom battles, instead of getting hundreds of millions of dollars through relatively quick settlements.

In the past two weeks, two of the biggest banks were hit with separate mortgage-related lawsuits.

One from the U.S. Attorney's office in Manhattan accused Wells Fargo of misleading the government in a "longstanding and reckless" pattern of certifying the quality of questionable home loans and failing to report problems on others.

It said the deception forced the government to pay out hundreds of millions of dollars in insurance claims. Authorities are seeking hundreds of millions of dollars in damages.

Instead of quickly settling the charges, as has happened in most financial-crisis cases, Wells Fargo is contesting the allegations.

Part of its defence will be that the $25 billion (15 billion pounds) federal-state mortgage settlement reached earlier this year with top banks already cleared out some of this liability, Wells Fargo Chief Financial Officer Tim Sloan said in an interview on Friday.

"There was a lot of disappointment from our perspective in terms of how it was handled, and in particular we were very disappointed in some of the sensational allegations that were made," Sloan said, adding that the bank strongly denies the charges. The earlier settlement covered a certification that Wells says is partly at issue in the new complaint.

In the other case, New York State Attorney General Eric T. Schneiderman last week filed a civil suit against JPMorgan for alleged fraud at Bear Stearns, which JPMorgan bought at the government's request in 2008.

JPMorgan is also fighting back against those charges. Chief Executive Jamie Dimon lashed out this week in Washington at a public event, saying his bank has already paid its price. It took on up to $10 billion in losses related to Bear Stearns for doing the Federal Reserve "a favour.

Rita Glavin, a former Justice Department official who is a partner at the law firm Seward & Kissel, said banks may be reaching a point where they don't see the logic in settling cases because it's not allowing them to move past the liability.

"You may be seeing them saying, we're going to draw a line in the sand, and we're not simply going to lay down and get rolled over," Glavin said.

The strategy does come with some danger of new information being disclosed that private litigants can use in their own lawsuits against the banks.

But the civil cases also indicate the banks will likely face no criminal charges for the same conduct, potentially giving the banks less reason to immediately resolve them.

"If the banks have come to the determination that the worst that is going to happen is this civil case, then there is less of a downside for going forward," said Neil Barofsky, former inspector general of the TARP bailout who now teaches at New York University School of Law.

The Justice Department declined to comment. James Freedland, a spokesman for the New York Attorney General's office, said about the JPMorgan case: "It would be the ultimate legal loophole if accountability for billions of dollars worth of fraud upon taxpayers and investors could simply disappear into the ether because ownership of a company changed hands."

Some see a pattern of fresh aggression from authorities, especially out of New York, where top enforcement officials are elected. New York state banking regulator Benjamin Lawsky, who was appointed by the governor, came under fire in August when he broke from federal investigators and threatened to yank British bank Standard Chartered's state banking license over transactions tied to Iran.

Not all expected action has panned out. Goldman Sachs faced potential action from the Securities and Exchange Commission for its role in selling certain subprime mortgage securities, after it already agreed in 2010 to $550 million to resolve SEC charges related to another subprime mortgage product. The bank disclosed in August the SEC had dropped its investigation.

DRIP, DRIP, DRIP

For years, government enforcers have been criticized for not being forceful enough in pursuing marquee Wall Street banks and bankers for recklessly churning out loans, then spreading around the risk by repackaging and selling securities backed by those loans.

Earlier this year, President Barack Obama announced a new financial fraud task force. Bringing together federal and state enforcement efforts and avoid overlapping cases, it was billed as the most serious effort yet to bring high-level cases.

New York state's case against JPMorgan, for example, brought together the work of the Justice Department and investigators at the Federal Housing Finance Agency's inspector general's office.

But JPMorgan still faces potential action from the U.S. Securities and Exchange Commission, which is probing activity at JPMorgan Securities related to two mortgage securitizations.

JPMorgan disclosed that probe in February of this year, roughly eight months after JPMorgan Securities agreed to pay $153.6 million to settle charges it misled investors in a complex mortgage securities transaction.

Wells Fargo also faces potential SEC action related to the housing crisis. The bank received notice it may face SEC action related to its mortgage-backed securities offerings.

"We need to come up with some type of global settlement and say, 'The end. This is it.' It's just drip, drip, drip," said Nancy Bush, a veteran bank analyst and contributing editor with SNL Financial.

It's difficult to determine how much liability is still out there and whether banks have put enough money away to cover it.

JPMorgan and Wells Fargo both reported third-quarter results on Friday. Wells Fargo's "operating losses," an expense category that includes litigation, were $281 million in the third quarter, down nearly by half from the second quarter. The bank's reserves take into account the suit from the Manhattan U.S. Attorney's office, Sloan told analysts in a conference call.

JPMorgan reported litigation expenses of $800 million, up from $300 million in the last quarter but down from the $1.3 billion recorded one year ago.

Yeah, that stuff Aaron Rodgers was saying the other day about his own play not being up to par?

Never mind.

Rodgers was back to MVP Rodgers, and he dragged the Packers back to looking like champions along with him.

He was laser-sharp while carving up the Texans 42-24 Sunday night, completing 24-of-37 passes for 338 yards and six touchdowns, the same amount the Texans had allowed in their 5-0 start. (Watch the highlights here.)

And it wasn?t as if Rodgers stood back with clean pockets all day.

He stood in and took shots and delivered passes, he scrambled for first downs and more when plays broke down. He read through progressions, and found guys who weren?t the first choice.

In short, he was Rodgers again.

And as long as that?s the case, the 3-3 Packers are as good if not better than any team in the NFL.

Here?s another thing: They?re without their best wideout in Greg Jennings, although Jordy Nelson is quickly making that a debate. And a guy with bad hands (James Jones) has caught multiple touchdowns in three straight games.

Those things don?t happen in a vacuum, or with anything short of the best quarterback in the game throwing it to them.

Here are five more things we learned during Sunday Night Football:

1. The Texans didn?t look like the undefeated team that really hadn?t been pushed.

Or maybe they did.

The Texans were able to beat five teams by an average of 15.2 points per game coming into this one, and it might not be an accident that all five were AFC teams.?In fact, the toughest of the lot might have been the Jets game, and the Jets can play a physical style you see more often in the other conference.

But from Connor Barwin trying to play buck-buck like Fat Albert on a field goal, to Danieal Manning trying to punch out from the bottom of a pile, the Texans played without much composure, which doesn?t bode well for the games that matter in January, when somebody else might punch back.

2. It?s not exactly breaking news to say that J.J. Watt is having a phenomenal year.

But with two more sacks, pushing him to 9.5 in six games, it becomes more amazing with each passing week.

A 3-4 defensive end is simply not supposed to do be able to do this. The job description, as originally written, doesn?t come close to what Watt is capable of doing. Ends in the 3-4 are supposed to contain the run, be solid and clog lanes for outside linebackers to make the glory plays.

It?s not like a receiver leading the league in rushing, but it?s at least the equivalent of a tight end leading the league in receiving yards, and speaks to his singular talent.

3. The Packers can?t keep inside linebackers healthy, but that doesn?t cover up the fact that one of them is playing very well.

Desmond Bishop was lost for the year with a preseason hamstring, and his replacement D.J. Smith left the game with a knee injury after a suspect block by Texans left tackle Duane Brown.

But the other Packers inside linebacker, A.J. Hawk, has been more than just solid of late, playing very well against the run.?The Packers (who were also missing nose tackle B.J. Raji) held Texans running back Arian Foster to 22 yards on 13 carries in the first half, when the run game was a viable option.

Hawk has taken a lot of criticism, and it?s easy to make a case that he?s overpaid. But he?s played well when the Packers needed him most.

4. One other quick note on the Brown hit on Smith.

The Texans have now ceded the moral high ground, and can no longer complain about linebacker Brian Cushing?s season-ending injury from a block of similar intent by Jets guard Matt Slauson.

You can?t have it both ways, fellas.

A wise man told me once there?s a difference between innocent and righteous. Just because it wasn?t flagged doesn?t make it right.

5. The Texans spent a lot of money ($48.75 million for five years) on cornerback Johnathan Joseph, and they?re? not getting a return on their investment lately.

There was no injury reported during the game, but he came out for a few plays for backup Alan Ball.

The Texans struggled last week in the secondary against the Jets, and if they were playing a team with actual receivers (and more of a quarterback), it might have cost them then.

It caught up with them Sunday night.

Joseph is a good cover player, but his two-week lapse is noticeable, and something they can?t afford.
